The user’s email address as well as any other personal information will be kept strictly confidential. We do not share email addresses or any other letter information with any third party advertisers. Any email addresses submitted through Cheethi will be kept private under all circumstances except when used in the context of our products.

By using this Service, you agree to Cheethi’s terms and conditions regarding the collection, use, and disclosure of personal data and the choices you have associated with that data. These Terms don’t give us any rights to data shared by you in the form of text and media, except for the limited rights that enable us to offer the Services.

Definitions:

Services provided by Cheethi can be classified into;

The letters (text only) the user may write and choose to send to a future date privately, or to share on the public portal.

The physical letters the user may write and choose to send on a future date to themselves or a loved one.

Our terms and conditions of service may vary between these two, as is outlined below.

Data Usage:

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to your email address(es) and phone number(s), your full name and your complete address. In the case of the service being used to communicate with another individual, we may ask you to provide us with personal identifiable information that can be used to contact or identify said individual in addition to yourself.

We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

We may also collect information as to how the Service is accessed and used (“Usage Data”). This Usage Data may include information such as your computer’s Internet Protocol address, browser type, browser version, the frequency of your visit, the pages of our website that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

This usage data may be shared with third-party Service Providers that we use to monitor and analyze the use of our Service.

Terms of Use:

Section 1: General Terms

Cheethi will not be held liable to retrieve a message should the user, under any circumstances, lose or forget the credentials required to access the email address submitted to the service.

We may, without notice and in our sole discretion, refuse to offer the services to any person or entity.

We assume no responsibility for the reliability, accessibility, timeliness, or any other quality of the services provided. Specifically, Cheethi is not to be held responsible for any untimely delivery of emails, physical letters, loss of data, or error in transferred data that may occur during use of this service. Furthermore, Cheethi is not to be held responsible for errors in translation should the user choose to translate any message using Google Translate or any other third-party translation service.

Section 2: Content

The user must agree to use no vulgar or abusive content, no content that may harm minors, no impersonation, not divulge information that they are legally bound to not be shared, nor transmit content that infringes any copyright, trademark, trade secret, or any unauthorized or unsolicited promotional ads, junk mail, spam, pyramid scheme, etc.

Age Limit:

Cheethi does not permit anyone under the age of 13 to avail of the services provided nor do we knowingly collect personally identifiable information from anyone under the age of 13.
If you are a parent or guardian and you are aware that your Child/Children have provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we will take steps to remove that information from our servers.

Payment:

We may provide paid products and/or services within the scope of the Service. In that case, we use third-party services for payment processing (e.g. Stripe).
We will not store or collect your payment card details. This information is provided directly to our third-party payment processors, Stripe, whose use of your personal information is governed by their respective Privacy Policies. Should there arise any unforeseen complications with regards to the payment gateway, Stripe respective terms and conditions will come into effect.
It is the responsibility of the user to ensure that the payment has been processed in order to avail of paid Services provided by Cheethi.

LIMITATION OF LIABILITY:

THE USER EXPRESSLY UNDERSTANDS AND AGREES THAT CHEETHI SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF CHEETHI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE, INCLUDING WITHOUT LIMITATION FAILURE OF THE SERVICE TO PERFORM ANY ACTIVITY.
